SMS/MMS Text Message Policy and Consent Agreement

Effective Date: June 9, 2021

By providing your mobile phone number to American Way Health Insurance, LLC (“American Way Health,” “we,” “us,” or “our”), you expressly consent to receive SMS and/or MMS text messages from us. These messages may include, but are not limited to: policy-related notifications, plan updates, billing reminders, service alerts, promotional offers, and other informational communications related to our insurance products and services.

1. Consent to Receive Text Messages

By voluntarily submitting your mobile number through our website, application, or any other means, you:

  • Affirm that you are the subscriber or customary user of the number provided;
  • Agree to receive recurring text messages (message frequency may vary);
  • Acknowledge that these messages may be sent using automated technology, including autodialers;
  • Confirm that consent to receive text messages is not a condition of purchase or obtaining insurance.

2. Opt-Out and Support

You may opt out of receiving text messages at any time by replying STOP to 888-669-7553. After opting out, you may receive a final message confirming your request.

3. Message and Data Rates

Message and data rates may apply. Charges are determined by your mobile carrier. American Way Health does not impose a separate fee for these messages.

We are not responsible for any delayed, undelivered, or misdirected messages due to carrier network issues.

4. Participating Carriers

Supported U.S. carriers include, but are not limited to: AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, InterOp, Cellcom, C Spire Wireless, Cricket, and Virgin Mobile.

Note: T-Mobile is not liable for delayed or undelivered messages.

5. Your Responsibilities

You agree to notify us immediately of any changes to your mobile number and to update your account to reflect these changes. Failure to do so may result in personal information being misdirected.

6. Information Collected and Use

We may collect certain information in connection with the SMS service, including:

  • Your mobile number;
  • Carrier information;
  • Message content, date, and time;
  • Any personal information you voluntarily provide.

This information may be used to:

  • Send messages in accordance with this policy;
  • Fulfill services you have requested;
  • Improve our customer service and communication processes;
  • Maintain compliance with applicable laws and regulations.

We do not sell or share your mobile number or text message data with third parties for marketing purposes without your explicit consent, consistent with our Privacy Policy.

7. Changes and Termination

We reserve the right to modify or terminate our SMS/MMS messaging program at any time, for any reason, and without advance notice. Any changes to this policy will be posted on our website.

8. Legal Compliance

This agreement is intended to comply with:

  • The Telephone Consumer Protection Act (TCPA);
  • The Florida Telemarketing Act (Fla. Stat. § 501.059);
  • Applicable federal and state privacy laws;
  • Industry standards including those set by the CTIA.
